Combating the Unethical Use of AI to Deny Surgical Prior Authorizations

May 8, 2024 | by Brad Bichey

The Challenge of Automated AI Denials

Automated AI denials in surgical prior authorizations have become a pressing issue in healthcare. Initially intended to streamline and enhance the efficiency of prior authorizations, AI systems like Cigna’s PxDx and UnitedHealth’s “nh Predict” have led to an increased rate of denials. While these systems were designed to expedite decision-making, they have instead sparked significant concerns over the fairness and accuracy of their automated judgments, especially in the context of necessary surgical procedures.

A 2022 study by the Office of the Inspector General highlighted that 13% of Medicare Advantage beneficiaries were denied necessary care that should have been approved under Medicare guidelines. This discrepancy underscores the critical issues in care delivery that arise from automated systems and emphasizes the need for a reassessment of their implementation and oversight.

The Misuse of AI and the Impact on Healthcare

Beyond accuracy, the core issue lies in the misuse of AI by insurers, who employ these technologies more as barriers than facilitators in patient care. This practice is part of a larger systemic issue within healthcare, where tools designed to improve efficiency are instead used to prioritize profit over patient access to necessary treatments.

Strategies to Enhance Surgical Care in the Era of Unethical AI

As stakeholders in surgical care, we have adopted a four-pronged strategy:

Increasing the Probability of Surgical Care

We leverage AI-driven systems to enhance the documentation submitted to insurers, using algorithms to analyze patient data against insurance prerequisites. This approach ensures all necessary conditions and documentation are met before submission, significantly boosting the likelihood of surgery approvals.

Decreasing Administrative Burden

By implementing AI to manage complex prior authorization tasks, we alleviate the administrative burden on clinical staff, allowing them to focus more on patient care.

Addressing the Audit Repayment Risk

We use AI to ensure accurate and comprehensive record-keeping, eliminating templated documentation. This reduces the risk of discrepancies and audit repayments.

Ensuring HIPAA Compliance

We integrate compliance monitoring into our AI systems, anonymizing patient identifiers where necessary, to ensure all patient information is handled in compliance with federal regulations.

As opposed to the insurance industry, we use these strategies to help fix the prior authorization problem, designing a supportive tool for surgical care delivery and increased patient access to surgical services.

Call to Action for Surgical Stakeholders

As leaders in healthcare, we must critically assess the role of AI, ensuring these tools support patient care rather than undermine it. AI has the potential to transform healthcare, but its application must adhere to ethical standards prioritizing patient well-being.

Surgeons and stakeholders must engage in strategic process rethinking. I invite all healthcare professionals to join me in adopting AI solutions that are transparent, ethical, and centered on patient care.
